Just curious… if a design was offered as plans for the build of a single aircraft, but the plans are no longer offered (usually due to the designer’s death and the family wants to avoid liability issues), what is the legality of building additional planes from a used set of plans?

Yes, the obvious answer is to try to get permission from the family, but what happens if the family says no and wants to shut down any further builds. I don’t have a specific case in mind; I just wonder if this situation can really end a good or successful design.
